As the name suggests, After The Event (or “ATE”) legal expenses insurance is a form of legal expenses insurance that is designed to be taken out after an event that gives rise to a claim has already occurred.
ATE policies are usually bespoke to the claim in hand and the level of risk that is involved, and can be purchased at any time during the claim process. However, in the majority of cases the policy will not cover any fees that have been incurred before it is taken out. It is also not possible to claim back the cost of the policy from your opponent if your claim is successful, and therefore ATE insurance will often be an unnecessary expense which can be avoided.
