Lauren McLaughlin, Partner, recently advised and assisted a former social care worker in her unfair dismissal and pregnancy and maternity discrimination complaints against her former employer, a well-known care home, in the Employment Tribunal.
The claimant was dismissed for alleged gross misconduct, shortly after informing her employer of her pregnancy. Allegations of misconduct were made against the claimant when preparing for her upcoming maternity leave. The timing of the allegations, the disciplinary process and disparity of treatment compared to the claimant’s colleagues, gave rise to complaints that the dismissal was because of the claimant’s pregnancy and upcoming leave.
At an incredibly uncertain and stressful time for the mother-to-be, facing a loss of employment and income, Curzon Green was instructed to represent the Claimant throughout proceedings and were able to negotiate a favourable settlement package ahead of a multi-day Final Hearing. The claimant is now able to move on and focus on her young family.
