Discrimination by perception is a form of direct discrimination.
Discrimination by perception involves a claimant being treated less favourably because the respondent mistakenly perceives the employee to have a protected characteristic.
Example: Someone submits their application for a vacancy that has arisen at the local butchers. The employer turns down the application because the person has an Indian name. The employer has wrongly perceived the person to be of the Muslim faith and assumes they would not want to deal with meat that is not halal. This is likely to be less favourable treatment because of religion or belief.
