Employment Tribunal Cost Order Success

We have successfully obtained a cost order against a Respondent company in the Employment Tribunal. The Judge found that the Respondent acted unreasonably in part of its conduct in the proceedings, by failing to concede disability at an earlier stage. This failure led to wasted costs in preparing for a preliminary hearing to determine disability.

Cost awards are very rare and are given in less that 0.2% of claims in the Employment Tribunal, with only 177 cost awards out of 103,973 total claims made in 2019/20 (based on last statistics available). Of these, only 47 awards were made to claimants.

We acted for the Claimant in this matter, who has a number of disabilities under the Equality Act 2010.
