Settlement Secured for Cohabiting Partner in Claim Under the Inheritance (Provision for Family and Dependants) Act 1975

Steven Organ in our contentious probate team represented a client who had been left in very difficult circumstances following the death of her long-term partner. Our client had lived with the deceased for almost twenty years and was financially dependant upon him. Unfortunately, the deceased never updated his will and when he died, the terms of an old will applied, making no provision for our client. Our team advanced a claim pursuant to the Inheritance (Provision for Family and Dependants) Act 1975 and were able to secure a settlement via negotiations after the exchange of pre-action letters. Our solicitors were also able to assist our client with securing the benefit of a dependant’s pension from the deceased’s employer. The settlement and pension benefit together will provide our client with financial security for the rest of her life.
