There is some provision within the Immigration Rules for a parent to be able to join their child in the UK, but there are numerous legal requirements which will need to be met for a parent visa to be successful.
Most non-British parents of children in the UK, will apply for a parent visa under the provisions contained within Appendix FM of the Immigration Rules. Under these provisions, a non-British parent can apply to join or remain in the UK with their child who is a British Citizen, settled in the UK, or in the UK with limited leave under Appendix EU. The child must be under the age of 18 and the parent must either have sole parental responsibility for the child, or the parent/carer that the child normally lives with must be a British Citizen in the UK, settled in the UK, or in the UK with limited leave under Appendix EU.
The parent must usually demonstrate that they have either sole responsibility for the child or direct access (in person) to the child. They must also meet the suitability, financial, English language, and accommodation requirements.
If their visa is granted, the applicant will be granted leave to enter or remain in the UK for up to 33 months and may work and study. Leave under this category may lead to settlement after five or ten years, depending on the applicant’s ability to meet the requirements throughout this period.
