Families in the UK who have a non-British relative living abroad, who requires long term care, can find it incredibly difficult to support them whilst they remain outside of the UK. Our team understands the difficulties faced by those with adult dependent relatives outside of the UK and how important their visa applications can be.
There is some provision for those who are non-British citizens living outside of the UK who require daily care and support and cannot acquire this in their country of origin, within Appendix FM of the Immigration Rules.
A non-British adult dependent relative, who requires long-term care as a result of age, illness or disability may apply to enter or remain in the UK to join a relative. The applicant must be the parent, grandparent, brother, sister, son, or daughter of the relative in the UK. The relative in the UK must be over 18 years old and either a British citizen, present and settled in the UK, with refugee leave or humanitarian protection, or with limited leave under Appendix EU.
The applicant must be unable (even with practical and financial help of their family members) to obtain the required level of care in the country where they are living because it is not available and there is no person in that country who can reasonably provide it, or it is unaffordable. They must also show that they can be adequately maintained, accommodated, and cared for in the UK by the relative without recourse to public funds.
If the application is successful, the applicant will receive leave in line with the UK relative’s status or indefinite leave to enter.
