Uzair deals with both contentious and non-contentious employment matters.
He has extensive experience in all aspects of multi-faceted Tribunal litigation and EAT matters, including the day to day running of claims and in advising both employers and employees on the strategic and tactical elements of litigation. Uzair has assisted in several high-profile, complex cases involving a breadth of emerging employment law issues. The most notable is the landmark case of Barrasso v New Look, which progressed to the EAT and became the first decided case on employee shareholder provisions in s.205A ERA 1996.
Uzair is well versed in regulatory matters, having advised on matters across several different sectors, including financial, pharmaceutical, public, charity and healthcare. Uzair has gained particular experience in whistleblowing detriment and discrimination claims, though advises on a wide range of employment matters, including disciplinary and grievances, equal pay and unfair dismissal.
On the non-contentious front, Uzair has advised leading employers in respect of large scale fire and rehire, the introduction of new policies and terms (in respect of which he has drafted complex contracts of employment, restrictive covenants, and staff handbooks), performance management, disciplinary, grievance and dismissal processes, as well as general HR/internal ER advisory matters. He has advised on the breach of restrictive covenants as well as the enforceability of the same.
Uzair has also advised on the implications of cross-border Joint Venture Agreements, trade restrictions in financial agreements, commercial supply agreements, and drafted consultancy agreements.
Uzair routinely assists employees in negotiating favourable exits, some of which concerned the protection of shareholdings.
Uzair currently sits on Employment Law Association (ELA)’s race equality committee and is committed to raising awareness of measures to achieve equality in employment law and public policy. He also sits on ELA’s Ethnic Minorities Lawyers and Allies’ Network (EMELAN) briefing team and co-edited the first newsletter.
In the dispute resolution team, Uzair has advised on and assisted with a number of matters including professional negligence claims, clinical negligence cases, business disputes, possession claims, construction disputes and defamation claims. He has acted for both Claimants and Defendants.
Uzair’s expertise in employment law and dispute resolution enables him to confidently advise on matters which span across both areas, such as employee injunctions and contract claims.
