With nearly 60% of British people heading abroad each summer for their holiday, it is useful to know your position if all does not go to plan. An accident abroad can be extremely costly, and it can be difficult to find out who is responsible. What can be done?
Those who have booked through a UK tour operator can rely on the Package Travel Regulations, so can sue the tour operator for pain and suffering caused by the personal injury even when the accident occurred abroad. This legislation also allows individuals to recover compensation for a ruined holiday. The tour operator is responsible for the faults of any of their suppliers or agents who provide services as part of the holiday.  

When do these apply?
For the regulations to apply, two of the following must have been booked with the operator: 
  • transport
  • accommodation
  • other tourist services not ancillary to transport or accommodation and accounting for a significant proportion of the package

What will I get?
You may be entitled to recover a number of items as compensation including: 
  • Loss of holiday value
  • Loss of enjoyment or mental distress and anxiety
  • Pain, suffering and loss of amenity similar to other personal injury claims
  • Special damages and future loss similar to other personal injury claims.

What can I do if my holiday isn't covered?
