There are only 4 situations in which redundancy is justified:
- Your employer is closing the business;
- Your employer is no longer continuing work of a certain kind;
- The amount of work the business is carrying out is reducing;
- The location of the business is changing.
If you are being made redundant and it is not one of the above reasons, you may have a claim for unfair dismissal.
If you are being made redundant your employer should follow reasonable redundancy procedures. These procedures involve a duty to consult the employees who may be affected by redundancy, consider alternative vacancies, give the correct statutory redundancy payment and provide the relevant employees with the right to appeal.
